Mental Incapacity

We offer advice in relation to issues concerning the welfare and management of financial affairs of persons suffering from mental incapacity, including applications to the Court of Protection, preparation of Lasting Powers of Attorney prior to the loss of mental capacity.  Advice and representation concerning Deprivation of Liberty/Liberty Protection Safeguards for those deprived of their liberty in residential placements and to their families.  We can also advise where there is a dispute between families and Social Services and/or Health Trusts concerning the best interests of family members who do not have mental capacity to make decisions under the Mental Capacity Act 2005.

Legal Aid

We have a contract with the Legal Aid Agency to provide advice and representation concerning these matters and in some cases, particularly which concern loss of liberty e.g. detention under the  Mental Health Act (sectioned patients) this may be free.
